It really all depends on how Sam got Emma. It’s from before Brett became Santa so that’s not it. But it’s possible that he got Emma from Pops. Pops was/is a GM and can see Larry. So what if Pops was or is a Narrative Wielder as well, and he saw that developing in Sam? If Pops knew about magic and the courts and all that, then he’d know about the dangers as well. And in those shoes… I’d want a guardian for my son as well.
